The petitioner apprehends his arrest in connection with N.D.P.S. Case No. 49 of 2017/ Raxaul P.S. Case No. 143 of 2017 registered under Sections 20, 22, 23 and 24 of the N.D.P.S. Act. The accusation is of recovery of 200 Gram Ganja and 8 Gram Brown Sugar, in 21 Puriya, to the shop of Sanjay Kumar, who disclosed that the Brown Sugar was purchased from this petitioner.
Learned counsel for the petitioner submits that it would appear from the F.I.R. that the name of the petitioner has come in the confessional statement of Sanjay Kumar. Moreover,
Patna High Court Cr.Misc. No.48064 of 2017 (2) dt.12-10-2017 the petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge-cum-Special Judge, East Champaran, Motihari, in connection with N.D.P.S. Case No. 49 of 2017/ Raxaul P.S. Case No. 143 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
