The petitioner seeks bail in Amas P.S. Case No. 71/2016, registered for the offences punishable under Section 379 and other sections of the Indian Penal Code and Section 17 of the C.L.A. Act.
The informant alleged that one person rang him claiming himself to be Santosh Yadav and a member of P.L.F.I. and threatened him to kill his 'Munsi'. It is further alleged that the accused persons came, damaged the machines and other articles, snatched mobiles from the labourers and demanded extortion. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. The name of the petitioner figured in the case during the course of investigation, from the mouth of
Patna High Court Cr.Misc. No.55371 of 2016 (3) dt.01-03-2017 witnesses, who stated that the miscreants were talking with each other by naming them. They disclosed the name of Ashish Yadav and others. It is submitted that similarly situated co-accused Ranvijay Yadav @ Bhim Yadav @ Ranvijay Kumar has already been enlarged on bail vide order dated 27.09.2016 passed in Cr. Misc. 40279/2016. The case of the petitioner stands on the same footing.
Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sub-divisional Judicial Magistrate, Sherghati, Gaya in connection with Amas P.S. Case No. 71/2016.
