====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 24-09-2025 Heard learned counsel appearing on behalf of the petitioner and learned APP for the State.

2. The petitioner seeks pre-arrest bail in connection with Sadar (Sonki O.P.) P.S. Case No. 328 of 2022 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. The motorcycle from which 174.450 litres of IMFL was recovered belongs to the petitioner, though the petitioner has claimed that the same was sold by him to one Anand Kumar Jha on 12.03.2019. Petitioner has not been able to produce the valid paper and forms submitted by him as per the provision of Motor Vehicles Act. Petitioner has four criminal cases pending against him being accused in different sections including

Patna High Court CR. MISC. No.63408 of 2025(2) dt.24-09-2025 2/2 Section 304A of the Indian Penal Code.

4. In view of the above, I am not inclined to enlarge the petitioner on pre-arrest bail.

5. The petitioner may surrender before the learned District Court and seek regular bail.

6. The bail application stands disposed of.
