JUSTICE MOHIT KUMAR SHAH ORAL ORDER 26-09-2022 Though the present writ petition has been filed for quashing the Encroachment case no. 10 of 2017-18, initiated by the Circle Officer, Motihari, East Champaran i.e. the respondent no. 4, however, the learned counsel for the petitioners, at the outset, seeks liberty on behalf of the petitioners to file their objections/ show cause replies to the notice dated 20.04.2018, issued by the respondent no. 4. Liberty so sought, is granted. The writ petition stands disposed off. It is needless to state that in case, appropriate objection/ reply is filed within a period of four weeks from today and in case, Encroachment case no. 10 of 2017-18 is still pending, status quo, existing as on today, qua the land/ house of the petitioner, shall be maintained till the passing of the final order by the respondent no. 4 under Section 6(1) of the Bihar Public Land Encroachment Act, 1956.
