2. The petitioner apprehends his arrest in a case registered for the offence under Sections 115(2), 126(2), 303(2), 351(2), 109 and 3(5) of the Bhartiya Nyaya Sanhita, 2023.
3. As per F.I.R., on 04.07.2025 at about 9:30 PM, the informant was closing his shop, in the meantime, all the F.I.R. named accused persons along with some unknown persons, variously armed, came and on the instigation of this petitioner, other co-accused persons assaulted informant and his son. It is further alleged that accused persons also snatched cash of Rs. 5,000/- from the shop and also destroyed 100 bottles containing cold-drink & water worth Rs. 8,000/- from the shop.
4. Learned counsel for the petitioner submits that as per F.I.R. itself, petitioner is only alleged to be order-giver.
Patna High Court CR. MISC. No.64272 of 2025(2) dt.16-09-2025 2/2 There is no allegation of overt act against this petitioner. Specific accusation of assault and snatching cash is against other co-accused persons. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Kalyanpur P.S. Case No. 244 of 2025, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
