JUSTICE S. KUMAR ORAL ORDER 18-10-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner, who is in custody, seeks regular bail in connection with Majorganj Police Station Case No. 203 of 2016 registered for the offence punishable under Sections 385 and 386 of the Indian Penal Code.

The informant has alleged in the FIR that ransom of Rs. 10 lakhs was demanded on his phone. The caller disclosed his name as Raj Singh an Organization belongs to New Kshetriya Sangathan Fauj.

Learned counsel for the petitioner submits that the name of the petitioner transpired on the basis of only confidential information given by spy and nothing has been recovered from the

Patna High Court Cr.Misc. No.49095 of 2017 (2) dt.18-10-2017 possession of the petitioner. It has further been submitted that similarly situated co-accused persons namely Manish Kumar and Manish Bihari have already been granted bail by a co-ordinate Bench of this Hon'ble Court passed in Cr. Misc. Nos. 7874 of 2017 dated 02.03.2017 and 7335 of 2017 dated 09.03.2017 respectively. It has further been submitted that he is in custody since 20.02.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Sitamarhi, in connection with Majorganj P.S. Case No. 203 of 2016.
