JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner, learned counsel for the informant and also the learned counsel representing the State.
The petitioner wants to renew the prayer of bail which was earlier twice rejected vide order dated 15.12.2015 and 24.08.2016 passed in Cri. Misc. No. 50558 of 2015 and Cr. Misc. No. 27317 of 2016 respectively on the ground that the petitioner is suffering in custody since 22.06.2015 and trial has not been concluded as yet, to which the learned A.P.P. duly assisted by the learned counsel for the informant opposes the prayer of bail by submitting that now statement of the accused persons have been recorded under Section 313 of Cr.P.C. and now defence has to adduce evidence and for that the defence is taking time. In the facts and circumstances stated above,
Patna High Court Cr.Misc. No.54692 of 2016 (2) dt.21-12-2016 2/2 considering that the petitioner is the assailant and trial is likely to be concluded very soon and, as such, finding no good ground for reconsideration of prayer of the bail, again prayer of the bail of the petitioner stands rejected.
However, the learned trial court is directed to expedite the trial and conclude the same preferably within three months.
