2. The petitioner seeks bail in Raghopur P.S. Case No. 93 of 2024 registered for the offence punishable under Sections461, 379 of the Indian Penal Code.

3. As per prosecution case, in the night of date of occurrence, some unknown miscreants broke open the shutter of jewelries shop of the informant and committed theft of cash of Rs. 75,000/- as well as jewelries worth Rs. 6,05,000/-.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It has further been submitted that the co-accused in whose confessional statement, the name of the petitioner has

Patna High Court CR. MISC. No.66859 of 2024(2) dt.20-09-2024 2/2 figured has been granted bail by this court by order dated 04-092024 passed in Cr. Misc. No. 61239 of 2024. The case of the petitioner stands on similar footing. The petitioner is languishing in judicial custody since 22-03-2024.

5. Learned APP has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Birpur, Supaul in connection with Raghopur P.S. Case No. 93 of 2024, subject to the condition that the petitioner shall cooperate in the trial and make himself available as and when required by the court.
