2. The petitioner apprehends arrest in connection with Jokihat PS Case No.195 of 2025 dated 17.06.2025, instituted under Sections 140(3), 96, 303(2) of the Bharatiya Nyaya Sanhita, 2023.

3. The allegation against the petitioner is that he enticed away the minor daughter of the informant. It is also alleged that rupees thirty five thousand cash and some ornaments were also taken away by them.

4. Learned counsel for the petitioner submits that the victim girl is aged about 19 years. Her statement was recorded under Section 183 of the Bharatiya Nagrik Suraksha Sanhita, 2023, in which she has clearly stated that she was in love with

She herself went at the native village of the petitioner and thereafter went to Nepal where both have performed marriage in a temple on 11.06.2025 and started living together. There is no allegation of any wrong act against the petitioner. Lastly, it is submitted that the petitioner has no criminal antecedents.

5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria, in Jokihat PS Case No.195 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

7. The application stands allowed.
