In pursuance of the order dated 11.04.2018, Mr. Mahesh Narayan Parvat, learned Senior Counsel appearing on behalf of the respondent 1st set plaintiffs filed decree duly signed by the Presiding Officer in Title Suit No.177 of 2009. By the impugned order, the petition of the petitioner for impleading him as defendant along with his father in partition suit no.177 of 2009 has been dismissed. Since the final decree has already been prepared, therefore, this Miscellaneous petition has become infructuous. Accordingly, the same is dismissed. The petitioner, if so advised, may file petition for impleading him as defendant, in appeal in accordance with law.
