The petitioner seeks bail in a case instituted for the offence under Sections 302, 120(B) of Indian Penal Code and Section 27 of Arms Act.
It is alleged that on the date of occurrence, informant received information that his sister has been done to death. On that information he came to house of his sister and met his Bhagina, who disclosed that his Fufa, Mohammad Moharam Ansari along with Alim Ansari came there some days ago and on 03.01.2016 at 7.30 Alim Ansari alongwith three others had come to his house and thereafter his grand mother (petitioner) told his mother to prepare meal and when the meal was taken in side the room by the
Patna High Court Cr.Misc. No.2268 of 2017 (2) dt.04-02-2017 2/3 mother of Bhagina of the informant, in the meantime he heard altercation in the room and he also heard sound of firing. The Bhagina of the informant came out and informed neighbour, thereafter all four persons fled away. The Bhagina of the informant told that Nandosi Md. Moharam Ansari had come with Alim Ansari and he had made firing with three other persons. The mother of Bhagina of informant was taken to hospital but she succumbed to the injury. The petitioner told the Bhagina of the informant to not disclose the name to anybody otherwise miscreants could kill him.
In this manner, it appears no allegation of overt act is made against this petitioner. The petitioner is grand mother of Bhagina of the informant. It is merely alleged against her that she told the Bhagina of the informant to not disclose the name to any body otherwise they could kill him. Petitioner is a lady. Petitioner is in custody since 22.02.2016.
Considering the aforesaid facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Rohtas at Sasaram, in connection with Sessions Trial No. 462 of 2016, arising out of Kochas P.S.
