JUSTICE RAKESH KUMAR ORAL ORDER 31-10-2018 This is the second attempt for grant of anticipatory bail on behalf of the petitioner. On 23-3-2018, the anticipatory bail petition of the petitioner i.e. Cr. Misc. No. 57742 of 2017 was rejected by this Court, particularly in view of the fact that during investigation, accusation against the petitioner was found true and chargesheet was already submitted. The anticipatory bail petition was dismissed on 23-3-2018, even thereafter, the present anticipatory bail petition has been filed with same prayer i.e. for grant of anticipatory bail.

Sri Binod Kumar Singh, learned counsel, assisted by Ms. Vagisha Pragya Vacaknavi, learned counsel for the petitioner, submits that the Central Bureau of Investigation,

Patna High Court Cr.Misc. No.41584 of 2018(3) dt.31-10-2018 2/2 without examining the certificate of the petitioner, has forwarded the petitioner as accused.

Be that as it may, since on merit, the prayer for anticipatory bail of the petitioner was rejected, there is no reason to again entertain the same prayer. At the same time, it is also required to observe as to under what circumstances, once chargesheet was submitted against the petitioner and prayer for anticipatory bail was earlier rejected by this Court, how she is still at large till date.

The anticipatory bail petition stands again dismissed. Let a copy of this order be sent to the concerned Superintendent of Police, Central Bureau of Investigation. This order was passed in presence of Sri Bipin Kumar Sinha, learned Standing Counsel, Central Bureau of Investigation.
