The petitioner apprehends his arrest in connection with Complaint Case No. 28095 of 2014, registered under Section 498(A) of the Indian Penal Code and Section 4 of the Dowry Prohibition Act. The accusation is of torture of complainant by her husband (Petitioner) due to non-fulfillment of demand of dowry. Learned counsel for the petitioner submits that, in fact, the petitioner is ready to keep the complainant with full dignity. Further submission is that in the light of order passed in Maintenance Case No. 1907 (M) of 2014 by the Court of Addl. Principal Judge,
Patna High Court Cr.Misc. No.55707 of 2016 (5) dt.07-02-2017 2/2 Family Court, Patna the complainant is receiving Rs. 10,000/- per month.
Learned counsel for the informant has not denied about receiving of Rs.10,000/- in the light of order passed in Maintenance Case No. 1907(M) of 2014 by the Court of Addl. Principal Judge, Family Court, Patna.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the SDJM, Patna in connection with Complaint Case No. 28095 of 2014, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
