Petitioner apprehends his arrest in connection with Kotwali P.S. Case No. 403 of 2015 registered under Sections406, 409, 418, 420, 467, 468, 471, 120B, 167/34 of the Indian Penal Code.
The allegation against the petitioner is that he alongwith other accused, in criminal conspiracy, manufactured forged documents with forged signature of the informant and took loan.
Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. In fact, the Bank has instituted a case against the informant and accused,
Patna High Court Cr.Misc. No.735 of 2017 (3) dt.28-01-2017 2/2 Bishnu Kumar Sharma. It is further submitted that this Court while granting provisional bail to the borrower in Kotwali P.S. Case No. 665 of 2014 has directed him vide order dated 30.01.2015 passed in Cr. Misc. No. 4079 of 2015 to clear the total dues of the Bank within nine months. In retaliation to the above and with a view to save his skin, the informant has denied his signature and instituted the present case. Considering the facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Kotwali P.S. Case No. 403 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
