====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 10-09-2025 Heard Mr. Kishore Kumar Thakur, learned counsel for the petitioner and Mr. Md. Mushtaque Alam, learned APP for the State.

2. Petitioner seeks regular bail in connection with Banka Cyber P.S. Case No. 11 of 2025 registered for the offence(s) punishable under Sections 318(4), 336(3) and 338 of the BNS and sections 66(C), 66(E) and 67A of the I.T. Act.

The main submissions advanced by the petitioner's counsel are that the informant happens to be wife of this petitioner, the allegations levelled by her in the FIR with regard to creating fake facebook ID in the name of the informant and thereafter making viral obscene pictures of the informant by

No.64323 of 2025(2) dt.10-09-2025 2/3 using the said ID, are completely false as during the investigation, mobile phones having SIM, details of which has been mentioned in the FIR, were seized and after scanning and examination of the same technically, no incriminating evidence to support the informant's allegation has been found and further during the investigation no other lady, except one Gunjan Devi, came forward to support the informant's allegations and the said Gunjan Devi happens to be one of the friends of the informant, who simply filed Sanaha on the same date of lodging the FIR of the present matter. It is further submitted that petitioner himself surrendered before the police on 19.05.2025 and since then he has been languishing in jail. In fact, the petitioner was in Gujarat working there in a company and to extort money from him, the informant made false allegations against him.

4. The learned APP appearing for the State has opposed the bail prayer of the petitioner.

5. Heard both the sides, perused the FIR and the trial court's order. Though, there is serious allegation against this petitioner, however, considering his fair and clean antecedent and his custody period and mainly the completion of investigation against him and also taking into account the aforesaid pleas of the petitioner, I am inclined to release the

Patna High Court CR. MISC. No.64323 of 2025(2) dt.10-09-2025 3/3 petitioner on bail. Accordingly, let the petitioner named-above be released on bail in connection with Banka Cyber P.S. Case No. 11 of 2025 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
