2. The petitioner apprehends his arrest in a case registered for the offence under Sections 8(b), 18, 24 of the N.D.P.S. Act.

3. As per F.I.R., this petitioner is alleged to be indulged in cultivation of opium plants in the forest area.

4. Learned counsel for the petitioner submits that petitioner is innocent and has been made accused only on suspicion. The land, over which opium was allegedly cultivated, does not belong to this petitioner and entire land area is protected forest area. Petitioner is simply a villager and has got no concern with the alleged cultivation of opium plants. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge (N.D.P.S. Act), Gaya in connection with Bankebazar P.S. Case No. 44 of 2025, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
