JUSTICE ARUN KUMAR ORAL ORDER 17-10-2017 Heard learned counsels for the petitioners and the State as well as learned counsel for the Informant. The petitioners apprehend their arrest in connection with Naugachia P. S. Case No. 105 of 2017 instituted under Sections 366A and 120B/34 of the Indian Penal Code. The allegation, in brief, is that all accused persons kidnapped the daughter of the informant for the purpose of marriage with Aftab Ansari.
Learned counsel for the petitioners submits that in fact she eloped with Aftab Ansari and the girl is major and petitioners, being father and uncle, have been falsely implicated in this case and the girl has been recovered.
Patna High Court Cr.Misc. No.50016 of 2017 (2) dt.17-10-2017 2/2 Learned counsel appearing on behalf of the informant submits that girl in her statement recorded under Section 164 Cr.P.c. has named these two petitioners also, who kidnapped her along with others.
Having considered the nature of allegation and the statement of the girl, prayer for anticipatory bail of the petitioners is rejected.
However, if they surrender in the court below and move regular bail application, the same shall be considered on merit without being prejudiced by this order. (Arun Kumar, J) Sujit/- U T
