JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 30-01-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in connection with K. Nagar P.S. Case No. 264 of 2016, registered for the offences punishable under Sections 407, 409 and 420 of the Indian Penal Code.

Allegedly, the petitioner being miller received 424.35 quintals paddy and he was to provide 284.31quintals rice C.M.R. but he did not provide the rice, the value of which comes to Rs. 6,49,942.94 paisa.

Submission is of false implication and that petitioner was getting ready to supply the rice but in the meantime, the informant started demanding more rice resulting, the petitioner is

Patna High Court Cr.Misc. No.867 of 2017 (4) dt.30-01-2017 2/3 apprehending his arrest. The petitioner is ready to deposit 20% of the alleged amount within one month and on that ground the petitioner deserves sympathetic consideration. The learned A.P.P. opposes the prayer of pre-arrest bail.

In the facts and circumstances as stated above, the petitioner is directed to deposit 20% of the alleged amount of Rs. 6,49,942.94 paisa within one month through bank draft in the account of F.C.I., Banmankhi, Purnea and in the meantime, the petitioner in the event of his arrest or surrender shall be released on provisional bail on execution of bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction learned Chief Judicial Magistrate, Purnea, in connection with K. Nagar P.S. Case No. 264 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C., and after deposit of 20% of the said amount, the petitioner will file certificate accordingly in the learned Court below and then the provisional anticipatory bail granted to the petitioner shall be confirmed by the learned court below itself, failing which the bail granted shall be deemed to be cancelled.
