JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Giriak (Katrisarai) P.S. Case No. 80 of 2019 registered for the offences punishable under Sections 377, 511 of the Indian Penal Code and Sections 7, 8 and 18 of POCSO Act.
As per FIR petitioner is said to have committed unnatural offence with minor grandson of the informant. Submission of learned counsel for the petitioner is that there is delay of 8 days in lodging the FIR and even according to FIR occurrence took place at a distance of 8 kms., as such there is no eye-witness to the occurrence. Heard learned APP, who has opposed the prayer for anticipatory bail on the ground that witnesses have supported the prosecution case during investigation.
Patna High Court CR. MISC. No.59686 of 2019(3) dt.18-10-2019 2/2 In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He may surrender and pray for regular bail, which shall be considered on its own merit.
This application is, accordingly, dismissed.
