A show-cause has been filed on behalf of the opposite party no. 2 and with reference to the statements made therein, submission has been made that pursuant to the direction of this Court, the case of the petitioner was duly considered by the District Magistrate and a fresh reasoned and speaking order has been passed negating the claim of the petitioner, vide order

Patna High Court MJC No.4316 of 2016 dt.24-08-2023 2/2 dated 16.09.2019.

3. On the other hand, it is submitted on behalf of the petitioner that the grounds on the basis of which the claim of the petitioner was earlier rejected, the same has taken afresh in the aforenoted order dated 16.09.2019 and, as such, the order of the Hon'ble Court has not been complied in its letter and spirit and the concerned opposite parties are under contempt.

Considering the order of this Court dated 27.06.2016 whereby, this Court has remitted the matter back to the licensing authority for fresh consideration in accordance with law, this Court does not find any substance in the submission of the petitioner and accordingly, the present contempt application stands disposed of, however, the petitioner is at liberty, either to assail the order, if he feels aggrieved or to file a fresh application for issuance of new arms license.
