JUSTICE ANIL KUMAR SINHA ORAL ORDER 11-01-2023 Petitioner has renewed his prayer for regular bail in connection with Barh P.S. Case No. 205 of 2018 registered for the offence under Section 302 / 34 of the I.P.C. and Section 27 of the Arms Act inasmuch as earlier bail application of the petitioner was dismissed on 23.02.2022 vide Cr. Misc. No. 29087 of 2021.

Mr. Y.C. Verma, learned senior counsel for the petitioner submits that petitioner is in custody since 25.10.2019 but the trial has still not concluded.

This court vide its order dated 07-12-2022 has called for a report from the court below regarding progress of the trial and from perusal of the report submitted by Additional District & Sessions Judge 1st, Barh, it appears that out of nine charge-

Patna High Court CR. MISC. No.64762 of 2022(3) dt.11-01-2023 2/2 sheet witnesses, five witnesses have been examined and four witnesses are yet to be examined.

In view of the fact that trial is at the verge of conclusion, I am not inclined to grant bail to the petitioner at this stage.

The petition for bail stands rejected.

However, petitioner may renew his prayer for bail after four months if the trial does not conclude. (Anil Kumar Sinha, J) praful/- U T
