JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 17-11-2017 An affidavit has been filed stating therein that the address of the petitioners in the anticipatory bail application has wrongly been typed as 'both resident of Village-Karnpura, P.S.-Ganga Bridge, District-Vaishali at Hajipur (Bihar)', in place of 'both resident of VillageBidupur, P.S.-Bidupur, District-Vaishali at Hajipur (Bihar)'. In view of the said affidavit, the address of the petitioners stands corrected accordingly.

Let the Registry ensure that necessary entries

Patna High Court Cr.Misc. No.48846 of 2017 (2) dt.17-11-2017 2/3 are made in the computer data after correction of the address.

This application, for grant of anticipatory bail, arises out of Bidupur P.S. Case No. 61 of 2017, disclosing offences under Sections 363 and 366(A) of the Indian Penal Code.

The petitioners are parents of co-accused, namely, Banti @ Ravi Prakash.

Learned counsel, appearing on behalf of the petitioners, at the very outset, has drawn my attention to the statement of the victim girl, recorded under Section 164 of the Code of Criminal Procedure, to submit that there is nothing against these petitioners to constitute any offence.

Considering the submission, as above, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XIV, Vaishali at Hajipur, in connection with Bidupur P.S. Case No. 61 of 2017, subject to the

Patna High Court Cr.Misc. No.48846 of 2017 (2) dt.17-11-2017 3/3 condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
