The petitioner seeks bail in Barawar Tourist (Bishunganj) P.S. Case No. 39/17 registered under Section 414, 379, 511/34 of the Indian Penal Code and Section 25 (1-b)a, 26/35 of the Arms Act.
As per the prosecution case, four live cartridges are said to have been recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that the no incriminating article has been recovered from his conscious physical possession. Petitioner has been falsely implicated in this case at the instance of his enemies by planting the aforesaid cartridges. The petitioner has been languishing in custody since 16.07.2017.

No.50434 of 2017 (02) dt.18-10-2017 2 / 2 Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jahanabad in connection with Barawar Tourist (Bishun Ganj) O.P. P.S. Case No.39/2017.
