JUSTICE JYOTI SARAN ORAL ORDER 08-09-2017 Heard Mr. Sanjeev Kumar, learned counsel for the petitioner and Mr. Bipin Kumar, learned AC to SC-3, for the State. The petitioner is aggrieved by the order dated 23.12.2013 bearing Memo No. 2239 dated 31.12.2013 of the District Programme Officer, West Champaran, whereby the application of the petitioner has been rejected. The petitioner feeling aggrieved has moved in appeal before the appellate authority i.e. District Magistrate, West Champaran at Bettiah giving rise to R.M.Case No. 58/2015-16 but which remains

Patna High Court CWJC No.1094 of 2017 (3) dt.08-09-2017 pending before the District Magistrate, West Champaran and hence, the present writ petition.

Having heard learned counsel for the parties, for the present I deem it proper to dispose of the writ petition with a direction to respondent no.5, the Collector cum District Magistrate, West Champaran to consider the appeal preferred by the petitioner bearing R.M.Case No. 58/2015-16 and dispose of the same in accordance with law with due opportunity of hearing to the petitioner as well as respondent no.8, whose appointment is put to question in the appeal, expeditiously and preferably within three months from the date of receipt/ production of a copy of this order.
