2. This application has been filed for grant of regular bail to the petitioner in connection with Nagar P.S. Case No. 466 of 2023, registered for the offences under Section 20(B)(ii)(A) and 22 of the Narcotic Drugs and Psychotropic Substances Act.

3. As per the prosecution case, there is recovery of 500 grams of ganja which is small quantity.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case and he is in custody since 26.07.2023.

5. Learned APP has vehemently opposed the prayer of bail.

6. Let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of

Patna High Court CR. MISC. No.69490 of 2023(2) dt.01-11-2023 2/2 learned Sessions Judge-cum-Special Judge, NDPS, Begusari in connection with Nagar P.S. Case No. 466 of 2023.

7. While granting bail the petitioner shall be informed about the law regarding recovery of small quantity of ganja and the maximum punishment for the same. The Special Judge will also inform him that he may plead guilty and may not face the rigors of trial and if the petitioner pleads guilty, the special judge will proceed in accordance with law.
