Earlier the prayer for bail of the petitioner was rejected by this Court vide order dated 18.07.2017 in Criminal Miscellaneous No. 23845 of 2017 with an observation that petitioner may renew his prayer of bail after framing of charge before the court below. It has been submitted on behalf of the petitioner that charge has already been framed.

Heard learned A.P.P. also.

Having heard both sides, in view of the facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge, 3rd Nawada in connection with S.T. No. 592 of 2017-107 of 2017 arising out of Warsisaliganj P.S. Case No. 268 of 2016 subject to the following conditions:-

Patna High Court Cr.Misc. No.50302 of 2017 (2) dt.18-10-2017 (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner shall cooperate in the disposal of trial and appear on each and every date in Court and on failure on his part to appear before the court below on two consecutive dates, without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
