2. Petitioner is in custody in a case registered for the offence punishable under Sections 310(4), 310(5) of the BNS and 25(1-b)a, 26/35 of the Arms Act.

3. Allegation against the petitioner and other accused persons is that they have possessed some country made pistols and live cartridges.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He next submits that nothing has been recovered from the possession of the petitioner. He further submits that similarly situated co-accused persons have already granted bail by a coordinate Bench of this Court, namely, Golu Kumar and Sachin

Patna High Court CR. MISC. No.66304 of 2025(2) dt.17-09-2025 2/2 Kumar vide order dated 01.09.2025 passed in Cr. Misc. No.58707 of 2025 and, Dhiraj Yadav vide order dated passed in 08.09.2025 in Cr. Misc. No. 60145 of 2025. He next submits that petitioner is in custody since 01.07.2025 and has got no criminal antecedent as stated in para-3 of the bail petition.

5. Learned APP for the State opposes the prayer for Regular bail of the petitioner.

Considering the facts and circumstances of the case as well as the submissions made by learned counsel for the petitioner and also the fact that similarly situated co-accused persons have already granted bail by a co-ordinate Bench of this Court, namely, Golu Kumar and Sachin Kumar vide order dated 01.09.2025 passed in Cr. Misc. No.58707 of 2025 and, Dhiraj Yadav vide order dated 08.09.2025 passed in Cr. Misc. No. 60145 of 2025, let the above named petitioner be released on bail, on his furnishing bail bonds of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Bhagwanpur Hat P.S. Case No.302 of 2025 .
