Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341, 323, 308, 379, 504/34 of the Indian Penal Code.

As per the F.I.R petitioner no. 1 assaulted the informant's son with khanti on his head. Thereafter, the petitioner no. 2 snatched a watch and Rs five hundred of his son. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. There is a case and a counter case in which both sides sustained injuries. There is general and omnibus allegation

Patna High Court CR. MISC. No.68334 of 2022(2) dt.04-04-2023 2/2 against these petitioners and no overt act is alleged against them. The injury is simple in nature. Both parties are gotia and there is land dispute between them. Petitioners have got no criminal antecedent.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st class , Begusarai in Bhagwanpur P.S. Case No. 147 of 2016, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
