The petitioner seeks bail in a case registered under Sections 147, 148, 149, 341, 323, 324, 325, 307, 379, 504, 506 of the Indian Penal Code.

Allegation is that the accused persons including the petitioner assaulted the informant by means of farsa, rod, lathi and danda on his head, due to which he sustained injuries. When the mother of the informant came to save him, she was also assaulted by the accused persons and accused persons also looted chain, earring and Rs.25,000/- cash.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 29.07.2019 and has got no criminal antecedent. There is no allegation of tampering of

Free fight is alleged to have taken place. The injuries on the side of the accused persons have not been explained by the prosecution. The prosecution has not come with clean hands.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. (P) at Sitamarhi in connection with Bajpatti P.S. case No.118 of 2019.
