24-04-2023 Heard learned counsel for the parties.

The petitioner apprehends his arrest in a case registered for the offence under Sections 420, 409/34 of the Indian Penal Code.

Petitioner is alleged to have taken Rs. 8,52,000/- (eight lacs fifty two thousand) through four cheques to complete certain works under Nal-Jal Yojna, but he did not complete entire work and thus, caused loss to the government exchequer. Petitioner denies the prosecution case and submits that entire work has already been completed. It is further submitted that in completing the entire work, petitioner has incurred expenditure of Rs. 8,74,569/-, whereas, he received Rs. 8,52,000/- from the government and thus, he has expensed Rs. 22,569/- more in the said work. Petitioner has not cheated any money of the government and he bears clean antecedent.

Patna High Court CR. MISC. No.69974 of 2022(3) dt.24-04-2023 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - X, Siwan in connection with Goreyakothi P.S.
