1. Heard learned counsel for the petitioners and the learned APP for the State.

2. The petitioners apprehend their arrest in connection with Nabinagar P.S. Case No. 179 of 2021 dated 05.08.2021 registered for the offence(s) punishable under Section(s) 147, 148, 149, 323, 337, 338, 307, 332, 333, 353, 427, 435, 504, 283, 188 of the Indian Penal Code and Sections 3 and 4 of Public Property (Prevention of Damage) Act, 1985.

3. The main submissions advanced by the learned counsel for the petitioners are that in the FIR of instant matter altogether 76 persons including these petitioners have been named and 300-400 unknown persons have also been made

No.69369 of 2023(2) dt.08-11-2023 2/2 accused and as per the allegation, the accused persons blocked the road and committed arson on account of death of a person who jumped into a pond when he was being chased by the police and any specific role of any of the petitioners in the commission of alleged offence has not been revealed and the petitioners have got no criminal antecedent.

4. Learned APP appearing for the State has opposed the bail prayer.

5. Considering the above submissions, this court is inclined to accept the anticipatory bail prayer of the petitioners. Accordingly, let the petitioners named-above, in the event of their arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail in connection with Nabinagar P.S. Case No. 179 of 2021 on furnishing bail bonds of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Court concerned, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
