JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 17-10-2017 Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 379, 406 and 420 of the Indian Penal Code.

The accusation is of committing theft of the Bolero vehicle of the informant. The FIR was lodged against unknown and the name of the petitioner sprang up during investigation.

It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled. Neither anything has been recovered from the petitioner nor any specific evidence has been collected during investigation. However, the petitioner is ready to cooperate in the investigation. A statement has been made in paragraph 3 of

Patna High Court Cr.Misc. No.48158 of 2017 (2) dt.17-10-2017 2/2 the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj P.S. Case No. 308 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

The learned Court below will be at liberty to cancel the bail bonds of the petitioner, if he fails to co-operate in the investigation or fails to appear before the learned Court below on two consecutive occasions.
