2. The petitioner is seeking regular bail in connection with Excise P.S. Case No. 51 of 2024 for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
3. As per allegation, on a secret information, the police party reached the place of occurrence. Seeing the police party, two accused persons started fleeing away. The petitioner became successful in fleeing away whereas co-accused Nitish Kumar was apprehended. On search, 35 liters of country-made liquor and a mobile set of this petitioner were recovered from the spot.
4. The learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.68521 of 2024(2) dt.07-10-2024 2/2 that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that nothing has been recovered from his conscious possession and he is under custody since 01.08.2024.
5. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise-II, Khagaria in connection with Excise Khagaria Case No. 293C of 2024 arising out of Excise P.S. Case No. 51 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
