Petitioner apprehends arrest in connection with Cheriya Bariyarpur P.S. Case No. 39 of 2021 registered for the offence under sections 363, 365, 34 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner has not committed any offence as alleged in the first information report and he has been falsely implicated in this case. The present first information report has been lodged after 3 months of the alleged occurrence without there being any plausible explanation for the delay. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.67860 of 2022(2) dt.24-01-2023 2/2 and the submissions advanced on behalf of the parties, the petitioner, above named, is directed to be released on bail on furnishing personal bond to the satisfaction of Additional Chief Judicial Magistate, Manjhaul, Begusarai in connection with Bariyarpur P.S. Case No. 39 of 2021 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
