JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 24-11-2015 The petitioner applied for electric connection for running her Mill in the year 2008. As per instruction of the Board, he deposited a sum of Rs.5500/- by way of security. The case of the petitioner is that he was not granted electric connection as he failed to please some of the officials of the Board. He submits that the officials being having grudge against him lodged a false case being Gaurichak P.S. Case No.48 of 2010 alleging that the petitioner was illegally drawing energy from a nearby transformer. The petitioner submits that the said transformer is dead since may years and does not even have proper connection and wiring. In such circumstances, according to the petitioner, no one can draw line from it. He submits that even till date the transformer is not working.

A counter affidavit has been filed on behalf of the State wherein it has been stated that the petitioner was found drawing

Patna High Court CWJC No.13848 of 2012 (8) dt.24-11-2015 energy illegally from the nearby transformer. It has been further stated that the defence of the petitioner can be duly taken care in the criminal case and up till now he has not filed any complaint before the Power Holding Company.

Without expressing any opinion on the merit of the case, this writ application is disposed of with liberty to the petitioner, if so advised, to file a complaint before the appropriate authority who would look into her grievance.
