JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-10-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Raniganj PS case no. 262 of 2017 registered for the offences punishable under Sections 420, 467, 468, 471 of Indian Penal Code.
The allegation against the petitioner is that while the police personnel were on day patrolling duty and had reached at Canara bank, Raniganj, they saw that some people had confined the petitioner and one another and were assaulting them. Upon enquiry, it transpired that the said two persons had fraudulently exchanged the ATM card of one person and were tried to flee away.
Patna High Court Cr.Misc. No.49935 of 2017 (2) dt.17-10-2017 2/2 The learned counsel for the petitioner submits that the petitioner has a clean antecedent and there is no allegation of defalcation or withdrawal of any money by using the said A.T.M. card.
In the facts and circumstances of the case, I deem it fit and appropriate to enlarge the petitioner on regular bail on furnishing bail bond of Rs. 20,000/- (Rs. Twenty thousand) with two sureties of the like amount each to the satisfaction of ?SubDivisional Judicial Magistrate, Araria in connection with Raniganj PS case no. 262 of 2017.
