2. The petitioner seeks regular bail in connection with Warisnagar P.S. Case No. 144/2024 (G.R. No. 1419/2024), registered for the offence under Sections 143, 341, 323, 324, 307, 354, 379, 504, 506 and 34 of the Indian Penal Code.
3. As per the prosecution case, the petitioner is said to have assaulted the victim with spade causing grievous injury on the head.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. There is case and counter case between the parties and also there is land dispute between them. Petitioner has clean antecedent and he is in custody since 24.07.2024.
5. Learned A.P.P. has vehemently opposed the prayer
Patna High Court CR. MISC. No.67205 of 2024(2) dt.25-09-2024 2/2 for bail.
6. Considering the facts and circumstances of the case and also considering the period of custody, this application for regular bail is allowed.
7. Let the petitioner above named, be granted bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Warisnagar P.S.
