JUSTICE RAMESH KUMAR DATTA) 06-02-2015 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner filed the present contempt application claiming willful violation of the order/ direction dated 28.6.2011 passed by a Division Bench of this Court in LPA No. 831/2009 and further violation of the order dated 30.10.2012 passed by a learned Single Judge of this Court in CWJC No. 20089/2012 in terms of order passed in LPA No. 831/2009. Learned counsel for the State informs that for the violation of the said order dated 28.6.2011 a large batch of
Patna High Court MJC No.2217 of 2013 (2) dt.06-02-2015 2/2 contempt petitions was filed which was dismissed by a Division Bench of this Court by order dated 14.7.2014. Again the matter was taken up in another batch of contempt petitions headed by MJC No. 871/2012 which has been dismissed by order dated 21.10.2014 after noting the relevant extract of order dated 14.7.2014 and also considering some further submissions made on behalf of the petitioners of those cases.
In the aforesaid view of the matter, this Court cannot take a different view from that taken by two other Division Benches of this Court.
The contempt application is, accordingly, dismissed.
