This application, for grant of anticipatory bail, arises out of Rajiv Nagar Police Station Case No. 158 of 2017, disclosing offences under Sections 420, 467, 468 and 471 of the Indian Penal Code.

It is alleged that from the possession of the petitioner, certain blank thermal white cards, likely to be used for preparation of forged adhar cards, were recovered. In addition, certain other articles were also recovered from the petitioner's possession.

Learned Counsel, appearing on behalf of the petitioner, has

Patna High Court Cr.Misc. No.48705 of 2017(2) dt.13-11-2017 2/3 submitted that no document could be recovered in course of alleged search and seizure, which can be said to be forged. It is also submitted that adhar cards are available on portal to be petitioner has no criminal antecedent.

Learned Counsel for the petitioner submits that if allowed anticipatory bail, the petitioner shall not flee from the course of investigation or trial.

Considering the above submissions, this application is allowed.

Let the petitioner, Lokesh Kumar Jaiswal, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge III, Patna, in connection with Rajiv Nagar Police Station Case No. 158 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail

Patna High Court Cr.Misc. No.48705 of 2017(2) dt.13-11-2017 3/3 bond shall be liable to be cancelled.
