The petitioner, who is in custody, seeks regular bail in connection with Pipra Police Station Case No. 38 of 2005 registered for the offence punishable under Sections 394 and 411 of the Indian Penal Code.

The informant has alleged in the FIR that two unknown persons snatched his motorcycle and Rs. 500/- from his pocket and fled away.

Learned counsel for the petitioner submits that the name of the petitioner transpired on the basis of only suspicion and nothing has been recovered from his possession. It has further been submitted that charges has already been framed in this case.

Patna High Court Cr.Misc. No.49093 of 2017 (2) dt.18-10-2017 It has further been submitted that similarly situated co-accused persons namely Anil Yadav, Ravindra Yadav and Mochi Yadav have already been enlarged on bail passed in Cr. Misc. No. 43782 of 2011 dated 20.12.2011. It has further been submitted that he is in custody since 21.03.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned F.T.C.- IInd, Supaul, in connection with Pipra P.S. Case No. 38 of 2005.
