The petitioner seeks bail in a case registered under Section 37(C) of the Bihar Prohibition and Excise Act, 2016. The prosecution case, in short, is that the petitioner was apprehended in drunken state.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 17-08-2019. It is alleged that the petitioner was found in drunken state. There is no recovery of liquor in the present case.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let

No.59981 of 2019(2) dt.23-09-2019 2/2 the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Saharsa in connection with Special (Excise) Case No. 380 of 2019 arising out of Saharsa P.S. Case No. 741 of 2019.
