JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-11-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The impugned order goes to show that except I.O and Doctor, almost all the prosecution witnesses have already been examined and the trail of the petitioner is on the verge of conclusion.

Therefore, in the aforesaid circumstance, I am not inclined to release the petitioner on bail on the ground mentioned by me in my previous order dated 04.03.2015 passed in Cr. Misc No. 44061 of 2014. Accordingly, the prayer for bail of the petitioner in connection with Session Trial no. 57 of 2015 arising out of Sultanganj P.S.Case No. 111 of 2013, pending in the court

Patna High Court Cr.Misc. No.48492 of 2017 (3) dt.01-11-2017 2/2 of 4th Additional Sessions Judge, Bhagalpur is again rejected. However, the trail court is directed to expedite the trail of the petitioner within four months from the date of receipt/ production of a copy of this order. It is made clear that if the trail court fails to conclude the trail of the petitioner within the above stated period due to laches of the prosecution, the petitioner may renew his prayer for bail before the learned trail court itself.
