Petitioner is apprehending his arrest in connection with Complaint Case No.2861© of 2017 , registered for offences punishable under Section 498(A) of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.

As per FIR, there is allegation of demand of Rs.01 lac and for that torturing and harassing her and secondly ousting her from the house. Petitioner happens to be husband of the complainant.

Submission of the learned counsel for the petitioner is that the allegation is false and concocted, which will appear

No.73479 of 2019(2) dt.21-11-2019 2/2 from the fact that he has also made submission before the learned Sessions Judge that he is ready to keep her and on that notice was issued to the complainant but in spite of that complainant did not appear before the learned court below and he is still ready to keep her with dignity and care. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Patna in connection with Complaint Case No.2861 © of 2017 subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition that if she appears and she is ready to reside with the petitioner and he is also ready to keep her with dignity and care..
