2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 365, 366 of the Indian Penal Code and sections 302, 328, 201/34 of the IPC was further added.

3. As per allegation in the FIR, 25 years old daughter of the informant went to Panapur Mazar to offer prayer and did not return. It is further alleged that informant had warned accused Umesh Tiwari for alluring his daughter.

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Accused Umesh Tiwari was in love with the deceased but her marriage was fixed elsewhere. Accused Umesh Tiwari, had given salfaas

Patna High Court CR. MISC. No.65341 of 2023(2) dt.01-11-2023 2/2 tot he victim (deceased) instead of medicine for stomach pain. No specific allegation is attributed to the petitioner. No one is the eye witness of the allege occurrence. Petitioner has got no criminal antecedent and languishing in judicial custody since 21.3.2023.

5. The application for bail is opposed by learned APP for the State and learned counsel for the informant.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJM, Kaimur at Bhabhua in connection with Mohaniyan P.S. Case No. 200 of 2023.
