2. The petitioner seeks bail in connection with Mairwa P.S. Case No. 161 of 2023 registered for the offence punishable under Sections 279 and 427 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. As per the persecution case, the petitioner is an accused of smuggling 250 litres of illicit liquor.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case on the basis of suspicion. There is nothing on record to show the involvement of the petitioner in manufacturing of illicit liquor. The petitioner is in custody since 02.06.2023.

5. Learned APP appearing for the State opposes the

Patna High Court CR. MISC. No.67049 of 2023(2) dt.16-10-2023 2/2 prayer for regular bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learnedExclusive Special Excise Court-I, Siwan in connection with Mairwa P.S. Case No. 161 of 2023.
