The petitioner apprehends his arrest in connection with Excise Case No.818 of 2019 registered under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016. The accusation is of recovery of 13 bottles, each containing 375 ml. Indian Made Foreign Liquor, from a ditch, situated behind the house of the petitioner.

Learned counsel for the petitioner submits that it would appear from the prosecution report that the alleged recovery was made from the ditch, situated behind the house of the petitioner, but the same is far away from the house of the petitioner. The petitioner has no criminal antecedent.
