JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-09-2019 Earlier prayer for anticipatory bail of the petitioner was rejected, vide order dated 10.07.2019 passed in Criminal Misc. No. 42679 of 2019 with a direction to the petitioner to surrender before the learned court below within a period of six months.

This application has been filed for modification of the order dated 10.07.2019 passed in Criminal Misc. No. 42679 of 2019 on the ground that petitioner has gone out as his brother was seriously ill, he could not surrender.

Heard learned APP also.

Having heard both sides, considering the submissions, I am not inclined to interfere with the earlier order passed by this Court. However, petitioner shall surrender before the

Patna High Court CR. MISC. No.59341 of 2019(2) dt.25-09-2019 2/2 learned court below and make prayer for regular bail, the same shall be considered on its own merit and considering the fact that earlier petitioner has been granted anticipatory bail, but he could not appear due to some reason, and if possible to be disposed of on the same day.
