2. The petitioner apprehends his arrest in connection with Kasma P.S. Case No. 115 of 2023, registered for the offences punishable under Sections 413, 414/34 of the Indian Penal Code.

3. As per allegation, in course of patrolling, the informant caught one black Passion Pro Motorcycle riding by two persons. On thorough enquiry from them, they accepted that this is stolen motorcycle and they are using this motorcycle for carrying illegal liquor for last six months. The accused persons could not be able to produce the paper of said motorcycle. The motorcycle was seized and seizure list was prepared.

4. The learned counsel for the petitioner has submitted that the arrested accused had apprised the police that he purchased

Patna High Court CR. MISC. No.67672 of 2023(2) dt.19-10-2023 2/2 his motorcycle from the petitioner. Except the confessional statement of co-accused, there is nothing against the petitioner.

5. On the other hand, the learned APP has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate- 1st Class, Aurangabad in connection with Kasma P.S. Case No. 115 of 2023, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Nawneet Kumar Pandey, J) Nirmal/Kundan U T
