2. The petitioner apprehends his arrest in a case registered for the offence under Sections 376, 504, 506, 509, 511/34 of the Indian Penal Code and Section 67 of the I.T.Act.
3. As per F.I.R., allegation against petitioner is that he alongwith other two co-accused persons tried to commit rape with informant, however, on alarm raised by her, all the three persons fled away. It is further alleged that co-accused Injamamul Haque sent obscene material on Whatsapp of informant, abused her and also threatened to kill informant's family members.
4. Learned counsel for the petitioner submits that the prosecution case, as set out in the F.I.R., is absolutely false and concocted. Victim is major and specific accusation is against co-
Patna High Court CR. MISC. No.63432 of 2025(2) dt.15-09-2025 2/2 accused Injamamul Haque, who has been granted bail by a coordinate Bench of this Court, vide order dated 29.11.2023 passed in Cr.Misc. No. 55594 of 2023 (Annexure - 2). There is delay of 1 month & 21 days in lodging the F.I.R. and there is no plausible explanation of delay. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge (Rape & POCSO Act), West Champaran, Bettiah in connection with Yogapatti P.S. Case No. 273 of 2023, subject to condition as laid down under Section 438(2) of the Cr.P.C. / Section 482 of the B.N.S.S.
