2. The petitioner has preferred this application for grant of regular bail in connection with K.Nagar P.S. Case No. 53 of 2025 dated 28.02.2025 registered for the offences punishable under Section 8(c) & 21(b) of the N.D.P.S Act.
3. As per the prosecution case, the informant being SubInspector of Police of K. Nagar Police Station got secret information that a person is going to take a large consignment of Heroine (Brown Sugar/Smack) via Banbhag towards K.Nagar Chowk, acting upon the same he apprehended one person namely Rakesh Kumar (co-accused) on a Apache motorcycle and upon search two packets of narcotics substance
Patna High Court CR. MISC. No.62985 of 2025(2) dt.15-09-2025 2/3 (Smack/Brown Sugar) weighing total of 204.05 grams was recovered from him and on inquiry he revealed the name of the present petitioner that he does business of smack from his rented house. Thus, he was named in the FIR.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the possession of the petitioner. The petitioner has no concern with the alleged occurrence his name has been surfaced on the confessional statement of the co-accused person. It is further submitted that the petitioner has earlier been implicated in one NDPS Case in the year 2024 and due to some dispute with the police he has been motively implicated in the present case. The seized contraband is less than the commercial quantity. The petitioner has three criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 27.06.2025.
5. Learned A.P.P. for the State has opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, and further considering that the name of the petitioner has been surfaced on the confession of the co-accused and nothing incriminating has been

No.62985 of 2025(2) dt.15-09-2025 3/3 found from the conscious possession of the petitioner, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (NDPS Act), Purnea in connection with K.Nagar P.S. Case No. 53 of 2025, with the following condition: (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
7. The application stands allowed.
